CWA WINS MEDCO CASE
An arbitrator ruled that the State violated the state Worker Contract when it permitted Medco to unilaterally change our prescription drug plan.
The contract provides that we pay $3 for a generic, $10 for a brand where there is no generic available, and $25 for a brand where there is a generic and there is no medical reason to not take the generic.
Medco unilaterally implemented a "non preferred" category. Drugs that were not on the preferred list were not covered. Drugs are on the preferred list because Medco gets rebates for them and so they want you to take that drug.
Any worker who had to pay for their prescription because Medco wouldn't cover it has to be paid back.
